A convincing argument can change a discussant’s commitment regarding the acceptability of a claim, but the same effect can be achieved by examining evidence. Observing objects or events that count as evidence for or against the acceptability of a statement can change one’s commitment regarding that statement. If we speak of fallacies in the realm of convincing through argumentation, can we speak of fallacies in the realm of convincing through evidence? In this paper, we defend an affirmative answer. We introduce (...) and discuss the conceptual implications of evidentiary fallacies as fallacies committed when evidence is fabricated or suppressed during an attempt to resolve disagreement using proof. We then apply the notion of evidentiary fallacy to two real-life examples of mis-executed evidentiary procedures. We conclude that the notion of evidentiary fallacy can contribute to a more comprehensive fallacy theory and can foster new and broadly applicable critical skills. (shrink)

In this paper we aim to examine a novel view on distributive justice, i.e. limitarianism, which claims that it is morally impermissible to be rich. Our main goal is to assess the two arguments provided by Ingrid Robeyns in favour of limitarianism, namely the democratic argument and the argument from unmet urgent needs and the two distinct limitarian views which these arguments give rise to. We claim that strong limitarianism, which is supported by the democratic argument, should be rejected as (...) it fails to fully instantiate the value of political equality, while having some other unattractive implications as well. By contrast, we argue that weak limitarianism, which is supported by the argument from unmet urgent needs, should be endorsed, albeit in a qualified version which also takes responsibility constraints into consideration. We address the old question whether a logical understanding of Quantum Mechanics requires abandoning some of the principles of classical logic. Against Putnam and others (Among whom we may count or not E. W. Beth, depending on how we interpret some of his statements), our answer is a clear "no". Philosophically, our argument is based on combining a formal semantic approach, in the spirit of E. W. Beth's proposal of applying Tarski's semantical methods to the analysis of physical theories, with (...) an empirical-experimental approach to Logic, as advocated by both Beth and Putnam, but understood by us in the view of the operationalrealistic tradition of Jauch and Piron, i. e. as an investigation of "the logic of yes-no experiments" (or "questions"). Technically, we use the recently-developed setting of Quantum Dynamic Logic (Baltag and Smets 2005, 2008) to make explicit the operational meaning of quantum-mechanical concepts in our formal semantics. Based on our recent results (Baltag and Smets 2005), we show that the correct interpretation of quantum-logical connectives is dynamical, rather than purely propositional. We conclude that there is no contradiction between classical logic and (our dynamic reinterpretation of) quantum logic. Moreover, we argue that the Dynamic-Logical perspective leads to a better and deeper understanding of the "non-classicality" of quantum behavior than any perspective based on static Propositional Logic. Since Kaplan : 81–98, 1979) first provided a logic for context-sensitive expressions, it has been thought that the only way to construct a logic for indexicals is to restrict it to arguments which take place in a single context— that is, instantaneous arguments, uttered by a single speaker, in a single place, etc. In this paper, I propose a logic which does away with these restrictions, and thus places arguments where they belong, in real world conversations. The central innovation is (...) that validity depends not just on the sentences in the argument, but also on certain abstract relations between contexts. This enrichment of the notion of logical form leads to some seemingly counter-intuitive results: a sequence of sentences may make up a valid argument in one sequence of contexts, and an invalid one in another such sequence. I argue that this is an unavoidable result of context sensitivity in general, and of the nature of indexicals in particular, and that reflection on such examples will lead us to a better understanding of the idea of applying logic to context sensitive expressions, and thus to natural language in general. We formalise a notion of dynamic rationality in terms of a logic of conditional beliefs on plausibility models. Similarly to other epistemic statements, dynamic rationality changes its meaning after every act of learning, and it may become true after players learn it is false. Applying this to extensive games, we "simulate" the play of a game as a succession of dynamic updates of the original plausibility model: the epistemic situation when a given node is reached can be thought of as (...) the result of a joint act of learning that the node is reached. We then use the notion of "stable belief, i.e. belief that is preserved during the play of the game, in order to give an epistemic condition for backward induction: rationality and common knowledge of stable belief in rationality. This condition is weaker than Aumann's and compatible with the implicit assumptions underlying Stalnaker's criticism of Aumann's proof. The "dynamic" nature of our concept of rationality explains why our condition avoids the apparent circularity of the "backward induction paradox": it is consistent to believe in a player's rationality after updating with his irrationality. In this paper I aim to provide a novel account of the Democratic Argument for limitarianism. I first claim that the standard version of this argument is questionable due to its reliance on a problematic central premise, namely that excessive wealth damages democracy because of its detrimental impact on political equality. Subsequently, I relocate the fundamental democratic worry in regard to excessive wealth in the process of backsliding, and more specifically in the relation between excessive wealth and political polarization. I (...) then offer a new account of the Democratic Argument for limitarianism which envisages wealth capping as instrumental for democratic resilience, but I maintain that the argument is not unambiguously successful. In this article I aim to offer a first critical assessment of the most prominent arguments in favour of restricting the voting rights of senior citizens. The first argument discussed, most thoroughly articulated by van Parijs, maintains that intergenerational justice would be improved under schemes which restrict the voting rights of senior citizens, thereby diminishing their overall electoral weight. The second argument, reconstructed from Lau's defence of child enfranchisement, maintains that the cognitive decline associated with the process of aging should (...) lead us to treat children and senior citizens identically in respect to electoral rights; thus, if we agree that children should not have the right to vote, consistency dictates that senior citizens should be disenfranchised as well. I respond to these arguments with several objections, arguing that the former relies on a number of faulty empirical premises and has deeply unattractive implications for enfranchisement once consistently applied, and that the latter fails to make empirically salient distinctions between children and senior citizens when it comes to the political domain. The classical rule of Repetition says that if you take any sentence as a premise, and repeat it as a conclusion, you have a valid argument. It's a very basic rule of logic, and many other rules depend on the guarantee that repeating a sentence, or really, any expression, guarantees sameness of referent, or semantic value. However, Repetition fails for token-reflexive expressions. In this paper, I offer three ways that one might replace Repetition, and still keep an interesting notion of (...) validity. Each is a fine way to go for certain purposes, but I argue that one in particular is to be preferred by the semanticist who thinks that there are token-reflexive expressions in natural languages. In this paper, I propose a new way to distinguish between indexicals, like “I” and “today”, and demonstratives, like “she” and “this”. The main test case is the second person singular pronoun “you”. The tradition would generally count it as a demonstrative, because the speaker’s intentions play a role in providing it with a semantic value. I present cross-linguistic data and explanations offered of the data in typology and semantics to show that “you” belongs on the indexical side, and argue (...) that they can be generalized to a novel criterion for distinguishing between indexicals and demonstratives. The central theoretical claim is that the semantic values of indexicals are objects which play certain utterance-related roles, which are fixed independently of the words being used in the utterance. For instance, the speaker plays the speaker role whether or not she uses the word “I”, and the addressee plays that role whether or not the speaker uses the word “you”. Demonstratives, on the other hand, pick out objects that play no such role, and are instead helped by the speaker’s word-specific intentions. (shrink)

We study the learning power of iterated belief revision methods. Successful learning is understood as convergence to correct, i.e., true, beliefs. We focus on the issue of universality: whether or not a particular belief revision method is able to learn everything that in principle is learnable. We provide a general framework for interpreting belief revision policies as learning methods. We focus on three popular cases: conditioning, lexicographic revision, and minimal revision. Our main result is that conditioning and lexicographic revision can (...) drive a universal learning mechanism, provided that the observations include only and all true data, and provided that a non-standard, i.e., non-well-founded prior plausibility relation is allowed. We show that a standard, i.e., well-founded belief revision setting is in general too narrow to guarantee universality of any learning method based on belief revision. We also show that minimal revision is not universal. Finally, we consider situations in which observational errors may occur. Given a fairness condition, which says that only finitely many errors occur, and that every error is eventually corrected, we show that lexicographic revision is still universal in this setting, while the other two methods are not. In this paper I show that Elga’s argument for a restricted principle of indifference for self-locating belief relies on the kind of mistaken reasoning that recommends the ‘staying’ strategy in the Monty Hall problem.

The domain of modal epistemology tackles questions regarding the sources of our knowledge of modalities (i.e., possibility and necessity), and what justifies our beliefs about modalities. Virtue epistemology, on the other hand, aims at explaining epistemological concepts like knowledge and justification in terms of properties of the epistemic subject, i.e., cognitive capacities and character traits. While there is extensive literature on both domains, almost all attempts to analyze modal knowledge elude the importance of the agent’s intellectual character traits in justifying (...) beliefs about what is possible or necessary. My aim in this paper is to argue that intellectual traits of character, like thoroughness, autonomy, epistemic courage and open-mindedness, are relevant to modal epistemology. (shrink)

In this article I aim to provide the first normative discussion of barter voting markets, namely markets which allow the trading of votes on issues/elections for votes on other issues/elections. The article is framed within the wider literature on the legal permissibility of vote buying, with a particular focus on the recent debate between Christopher Freiman and James Stacey Taylor. I argue that while Taylor's objections successfully defeat Freiman's case in favour of standard voting markets, they are unable to also (...) defeat the type of voting markets outlined here. Furthermore, I argue that there are at least two plausible prima facie reasons in favour of barter voting markets, grounded in their capacity to contribute to the alleviation of injustice for systematically disadvantaged socio‐economic groups and to their capacity to reduce one form of bad voting, i.e. voting from ignorance. We propose a refinement of STIT logic to make it suitable to model causal agency and responsibility in basic multi-agent scenarios in which agents can interfere with one another. We do this by supplementing STIT semantics, first, with action types and, second, with a relation of opposing between action types. We exploit these novel elements to represent a test for potential causation, based on an intuitive notion of expected result of an action, and two tests for actual causation from the (...) legal literature, i.e. the but-for and the NESS tests. We then introduce three new STIT operators modeling corresponding notions of causal responsibility, which we call potential, strong, and plain responsibility, and use them to provide a fine-grained analysis of a number of case studies involving both individual agents and groups. Synonymy, at its most basic, is sameness of meaning. A token-reflexive expression is an expression whose meaning assigns a referent to its tokens by relating each particular token of that particular expression to its referent. In doing so, the formulation of its meaning mentions the particular expression whose meaning it is. This seems to entail that no two token-reflexive expressions are synonymous, which would constitute a strong objection against token-reflexive semantics. In this paper, I propose and defend a notion of (...) synonymy for token-reflexive expressions that allows such expressions to be synonymous, while being a fairly conservative extension of the customary notion of synonymy. This paper discusses the proposal made by Lombardi and Labarca (Found Chem 7:125–148, 2005) that internal realism can secure the ontological autonomy of chemistry. I argue that internal realism is not, by itself, sufficient to accomplish this task. The fact that conceptual schemes may differ with respect to their theoretical virtues, and the possibility that the relations between them may be reductive undermine the premise that each conceptual scheme has an equal right to define its own ontology, which is a (...) key premise in Lombardi and Labarca’s proposal. In this paper I aim to examine some problematic implications of the fact that individuals are prone to making systematic reasoning errors, for resource egalitarianism. I begin by disentangling the concepts of preferences, choices and ambitions, which are sometimes used interchangeably by egalitarians. Subsequently, I claim that the most plausible interpretation of resource egalitarianism takes preferences, not choices, as the site of responsibility. This distinction is salient, since preference-sensitive resource egalitarianism is faced with an important objection when applied to situations (...) in which the empirically reasonable assumption that individuals have different degrees of computational abilities is introduced. I first show that this objection can be raised in cases involving individuals who have incomplete information, but that it ultimately fails for such cases since we can appeal to higher order insurance markets in order to mitigate any initial concerns. I further claim, however, that the objection is much more powerful in cases involving individuals who have different reasoning skills, since the appeal to higher order insurance markets is no longer tenable. Consequently, the ideal principle of justice proposed by Dworkin is met with a new feasibility challenge. Finally, I claim that the problem of reasoning errors and various forms of cognitive biases also affect Dworkin’s non-ideal principle of justice, skewing the outputs of the hypothetical insurance mechanism in an unjustifiable manner. The past decade or so has witnessed an increase in the number of philosophical discussions about emergence and reduction in science. However, many of these discussions (though not all) remain too abstract and theoretical, and are wanting with respect to concrete examples taken from the sciences. This dissertation studies the topics of reduction and emergence in the context of a case study. I focus on the case of chemistry and investigate how emergentism can help us secure the autonomy of this (...) discipline in relation to the underlying microphysics. I develop an account of emergence (called functional emergence) that is, I argue, capable of answering the question of why we have chemistry instead of just applied quantum mechanics. I argue that functionally emergent properties in chemistry -- properties that are defined by their behaviour, not by some shared microphysical constituent -- can help us defend the autonomy of chemistry; they allow for the existence of sui generis chemical regularities, which can be used in sui generis chemical explanations. Functional emergence generates difficulties for some accounts of inter-theoretic reduction, but unlike other theories of emergence it is compatible with weaker forms of reductionism. (shrink)

Standard accounts of democratic disenfranchisement either start from a presumption of universal inclusion and justify electoral exclusions as deviations from the norm, or attempt to draw a demarcation line between justifiable inclusion and exclusion relying on membership in the political community. Even when successfully employed, each strategy only provides a partial view of disenfranchisement, which is usually targeted at just one or two groups of agents. In this article, I develop a generally applicable account of disenfranchisement, grounded in a respect-based (...) understanding of the relational value of democracy. This account simultaneously provides the normative basis for widespread enfranchisement under equal terms and for justified electoral exclusions. (shrink)

Gettier cases are used to show that having a justified true belief is not sufficient for knowledge. They are cases in which an epistemic agent has a belief that is both justified and true, but intuitively cannot be taken to count as knowledge. Modal epistemology is the field of philosophy that tackles questions regarding the sources of our knowledge of modalities (possibility and necessity) and what offers justification for beliefs about what is possible or necessary. Part of the tradition in (...) modal epistemology is to consider conceivability as a guide to metaphysical possibility. As such, if an agent can conceive that P, then the agent is justified to believe that P is metaphysically possible. In this paper I will discuss the possibility of constructing Gettier cases for a tripartite, conceivability-based, definition of modal knowledge. (shrink)

This paper tackles Husserl’s early analysis of alien experience and its relation to the methodological framework of the _Logical Investigations_ (LI). Since intersubjectivity first becomes a central theme for Husserl in his writings of 1905 (_Seefeld Blätter_), less attention is usually paid to his analysis of our experience of other minds in the LI. In this context, I attempt to highlight both the fundamental insights gained by Husserl in this analysis that will also remain key for his later accounts of (...) empathy, as well as the challenges alien experiences raises for the theoretical framework of LI. I begin by discussing the main relevant traits of the phenomenological project of LI as a preparatory endeavor for the elucidation of logical objectualities, and the radical way in which Husserl defines its domain, i.e., the sphere of immanent content. Then I analyse Husserl’s understanding of alien experience in terms of an indicative unity based on associative motivations. I argue that, in doing this, Husserl accounts for a non-inferential intuitive access to other minds and, at the same time, maintains their essential alienness. Finally, I show that this account rests on what I call an “intentional contamination” of Husserl’s reductive method of LI. (shrink)

In this article I aim to counter Jason Brennan’s principled objection to the Representativeness Argument for compulsory voting, and to criticize the case in favour of voting lotteries, on which this challenge is predicated. In brief, Brennan claims that compulsory voting should be rejected because there is an alternative system, i.e. a voting lottery, which is able to ensure demographic proportionality in electoral turnouts without diminishing the freedom of citizens. But even on the most favourable conception of freedom which the (...) argument can employ, voting lotteries raise a number of serious concerns in respect to this value. Furthermore, while comparing voting lotteries and compulsory voting on the basis of freedom cannot provide any generalizable support for the former, a plausible case can instead be offered in support of the opposite idea, namely that compulsory voting outperforms voting lotteries with respect to freedom. McCall (1984) offered a semantics of counterfactual conditionals based on “real possible worlds” that avoids using the vague notion of similarity between possible worlds. I will propose an interpretation of McCall’s counterfactuals in a formal framework based on Baltag-Moss-Solecki events and protocols. Moreover, I will argue that using this interpretation one can avoid an objection raised by Otte (1987).

What grounds the truth of modal statements? And how do we get to know about what is possible or necessary? One of the most prominent anti-realist perspectives on the nature of modality, due to Peter Menzies, is the response-dependent account of modal concepts. Typically, offering a response-dependent account of a concept means defining it in terms of dispositions to elicit certain mental states from suitable agents under suitable circumstances. Menzies grounded possibility and necessity in the conceivability-response of ideal conceivers: P (...) is possible iff an ideal conceiver could conceive that P. I will draw attention to three major objections that can be identified in the modal metaphysics and epistemology literature: Chalmers’ Incoherency Objection, Sherratt’s Transparency Objection and Geirsson’s Irrelevancy Objection. Each of these objections raises a different worry regarding Menzies’ account: that the notion of an ideal conceiver is incoherent, that the account implies a controversial thesis, and that it fails to offer an explanation of our knowledge of modality. The aim of this paper is to defend the response-dependent account of modality against these three objections. (shrink)

In this paper I seek to assess the responses provided by several theories of sufficientarian justice in cases where individuals hold different conceptions of rationality. Towards this purpose, I build two test cases and study the normative prescriptions which various sufficiency views offer in each of them. I maintain that resource sufficientarianism does not provide a normatively plausible response to the first case, since its distributive prescriptions would violate the principle of personal good and that subjective-threshold welfare sufficientarianism as well (...) as objective-threshold welfare sufficientarianism committed to the headcount claim do not provide normatively plausible responses to the second case, since their distributive prescriptions would violate the principle of equal importance. I then claim that an objective-threshold welfare sufficientarian view committed to prioritarianism under the threshold offers the normatively plausible response to both cases and therefore resists the challenge raised by scenarios that involve differential conceptions of rationality. If the absence and disappearance of the body have enjoyed considerable attention in the social sciences, the same cannot be said about its appearance, other than during dysfunctional states such as pain and illness. The present article draws from a large array of phenomenological studies and presents a situation in which the body comes to the fore in one’s consciousness during the learning of combat sports, a seemingly destructive practice. The argument that I will develop, starting from extensive ethnographic research (...) in two distinctive combat sports, is that every type of bodily practice develops a specific type of reflective body awareness that has a significant impact upon both the way we feel our bodies and the way we feel the world. In other words, what we do with and to our bodies shapes the way we see and experience the world. (shrink)

Intentionalism is the view that a demonstrative refers to something partly in virtue of the speaker intending it to refer to that thing. In recent work, Una Stojnić has argued that the natural interpretation of demonstratives in some discourses is that they do not refer to the objects intended by the speaker, and instead refer to other things. In this paper, I defend intentionalism against this charge. In particular, I argue that the data presented by Stojnić can be explained from (...) an intentionalist point of view. The explanations take two forms: either the audience’s reaction to the discourse does not concern reference, or the natural interpretation is wrong. This latter claim has been defended by Stojnić in other work as applied to word identifi cation and is neutral between intentionalism and Stojnić’s objectivism. It is also very plausible. But it takes away the import of the argument from natural interpretation, at least in the form discussed here. (shrink)

This paper raises some concerns about Paul Humphreys’ fusion emergence in general and about his core example of fusion emergence (i.e., covalent bonding) in particular. It argues that the extent to which covalent bonding undermines the idea that our world’s ontology is wholly compositional has been overstated.

I. Science, myth, magic: three components of knowledge, in other words three types of activity in man who, in interaction with his surrounding environment seeks to accomodate himself to the constraints which this environment imposes on him while at the same time seeing to his own immediate or far-reaching needs.

Based on the transcript of a fragment from a philosophical practice session carried by Oscar Brenifier, I flesh out several aspects of this dialogical form of philosophical practice. First, it is a form of interaction grounded in the interlocutors’ interaffection. Second, the main mechanism of carrying through the dialogic interaction is the practitioner’s repeating the other’s words, writing them down, and then questioning them, thus extracting them from the other’s discursive flow and making them shared objects for an intersubjective gaze. (...) Third, this form of dialogue is asymmetrical: while the other is providing the “content”, the practitioner is responsible for explicating it. (shrink)

In the present paper I attempt an interpretation of Martin Heidegger’s analysis of animality, developed in winter semester 1929/1930. My general purpose is to examine Heidegger’s analysis in the wider context of formal-indicative phenomenology as such. Thus I show that in order to develop a phenomenology of animality, Heidegger must tacitly renounce the re-enactment of animal experience in which the formal-indicative concepts of his analysis could gain concreteness, and he resorts instead to scientific concepts and concrete experiments in biology or (...) zoology. This is due to the fact that what I call the a-logical bursts into the field of the phenomenological regard when it is oriented toward animality. I therefore argue that the phenomenology of animality presents us with a paradigmatic case of a tension that is at work in any phenomenon, one between logos and a-logos, between hiddenness and unhiddenness—constituting a basic problem of future research in phenomenology and its approach to intersubjectivity and alterity.
